1. Acceptance of Terms

By accessing or using BeRank mobile application, website, or any associated features and services (collectively, the “Service”), you acknowledge and agree that these Terms & Conditions constitute a legally binding agreement between you and BeRank . Your continued use of the Service signifies your acceptance of these Terms as well as the Privacy Policy governing the collection and processing of personal data. If you do not agree with any provision herein, you must immediately discontinue use of the Service.
BeRank reserves the right, at its sole discretion, to amend, modify, or revise these Terms at any time, with or without prior notice. Any modifications shall become effective upon publication on the Service. Continued access or use after such changes constitutes your acceptance of the revised Terms. Should you disagree with any revisions, your sole remedy is to cease using the Service.

2. Prohibited Activities

Users of the Service are strictly prohibited from engaging in activities that violate applicable laws, ethics, or the integrity of the platform. This includes submitting or disseminating content that promotes racism, hatred, discrimination, or physical harm against individuals or groups; uploading or sharing materials that are harmful, exploitative, or inappropriate for minors; engaging in harassment or encouraging others to harass any user; sending unsolicited communications, spam, or attempting to harvest personal information without consent; distributing content that is false, misleading, unlawful, abusive, defamatory, obscene, or offensive; uploading material that contains hidden, restricted, or unauthorized access pages; posting pornographic or sexually explicit content; providing information that encourages illegal conduct; uploading any form of malicious software including viruses, worms, or Trojan horses; soliciting personal data for unlawful purposes; engaging in unauthorized commercial advertising or promotional activities; using bots, scrapers, or automated tools without written permission; interfering with the proper functioning or security of the Service; attempting to reverse engineer, decompile, or disassemble any portion of the platform; or engaging in conduct that imposes unreasonable burdens on BeRank ’s infrastructure or that of its partners. Any breach of these prohibitions may result in suspension or termination of account access and potential legal action.

3. Neutral Venue and User Responsibility

BeRank functions solely as a neutral digital venue designed to facilitate matchmaking between players, enable match verification through QR-based systems, assist users in organizing games, and allow participants to track rankings and sports activities. BeRank does not supervise, manage, or intervene in user interactions, nor does it verify the identity, character, skill level, conduct, or legitimacy of any user or opponent. All engagements between users occur independently and at their own risk. BeRank disclaims any responsibility for disputes, injuries, losses, or adverse outcomes arising from user interactions, including in-person meetings. Users are solely responsible for exercising judgment, conducting due diligence, and taking necessary personal safety precautions before engaging with others through the Service. BeRank does not endorse or warrant the suitability, capability, or trustworthiness of any participant on the platform.

4. Intellectual Property

All content, trademarks, designs, algorithms, images, rankings, QR-based verification systems, and other intellectual or proprietary materials displayed on or incorporated within the Service (collectively, the “Intellectual Property”) are the exclusive property of BeRank or its licensors. Users are granted no rights, title, or interest in such Intellectual Property beyond the limited right to access and use the Service in accordance with these Terms. Except where expressly permitted in writing, users may not reproduce, copy, modify, distribute, transmit, display, or create derivative works based on the Intellectual Property. Unauthorized use constitutes a violation of copyright, trademark, and other intellectual property laws. Claims of copyright infringement may be submitted to
BeRank at the designated contact address and will be investigated in accordance with applicable legal standards.

5. User Obligations

By accessing the Service, you represent and warrant that you will use the platform strictly for lawful purposes and in compliance with all applicable laws and regulations. You agree to take all necessary safety precautions when meeting individuals connected through the Service and acknowledge that you assume all risks associated with such interactions. You further agree not to stalk, harass, defame, or harm any user; not to transmit unsolicited commercial or bulk communications; and not to use automated systems such as bots or crawlers to access or manipulate the Service. You shall refrain from interfering with the security, accessibility, or proper functioning of the platform, and you shall not impersonate any person or entity or submit content that violates privacy or publicity rights. BeRank reserves the unrestricted right to refuse service, suspend accounts, or terminate user access at any time and without prior notice for conduct it deems inappropriate, unlawful, or harmful to the platform or its users.

6. Fees and Subscription Terms

BeRank may provide the Service free of charge with support from advertising, sponsorship, or other third-party revenue models. Users may have the option to purchase subscriptions or in-app features that disable advertising or unlock enhanced functionalities. Subscriptions are processed through external platforms such as the Apple App Store or Google Play Store and are subject to their respective billing policies. Unless cancelled through the respective store’s subscription management system, subscriptions renew automatically at the end of each term and the applicable fees will be charged to the user’s selected payment method.
BeRank assumes no responsibility for disputes arising from billing or subscription management through third-party platforms.

7. Remedies for Breach

BeRank retains full discretion to take any action it deems appropriate in response to violations of these Terms. This may include, but is not limited to, suspending or terminating user accounts, blocking device or IP access, cooperating with law enforcement authorities, disclosing user information where legally obligated, notifying third-party service providers, or initiating civil or criminal proceedings. BeRank assumes no liability for actions taken in response to user misconduct and makes no representation that it will pursue every potential violation. Users acknowledge that they bear sole responsibility for all content and conduct associated with their accounts.

8. Disclaimer of Warranties and Limitation of Liability

The Service and all associated content are provided strictly on an “as is” and “as available” basis without any warranties of any kind, whether express, implied, statutory, or otherwise. BeRank expressly disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, reliability, accuracy, security, or uninterrupted availability of the Service. BeRank does not guarantee the truthfulness or reliability of information provided by users or the outcomes of matches or interactions arranged through the platform. To the fullest extent permitted by law,
BeRank shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, data loss, personal injury, reputational harm, or property damage arising from or related to the use of the Service. No action arising from these Terms may be brought more than six months after the event giving rise to the claim. Certain jurisdictions may not permit limitations on implied warranties; in such cases, limitations shall apply only to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless BeRank, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your breach of these Terms, your violation of any applicable law or third-party rights, or any content you submit, post, or share through the platform. This obligation survives the termination of your use of the Service.

10. Indemnification

These Terms and any disputes arising from or relating to the Service or your use thereof shall be governed by and construed in accordance with the laws of the jurisdiction designated by BeRank. Any legal action or proceeding shall be brought exclusively before the courts of that jurisdiction, and you hereby irrevocably submit to their personal and subject-matter jurisdiction. If you would like these Terms governed by Malaysian law or another jurisdiction, the text can be adapted accordingly.

11. General Provisions

All notices or communications regarding your account or use of the Service may be provided electronically, and you agree that such electronic communications constitute legally binding written communication.
BeRank may assign or transfer its rights and obligations under these Terms without restriction. You may not assign your rights without prior written consent. You may create hyperlinks to the Service provided they are fair, legal, and do not misrepresent affiliation; however, BeRank may require the removal of any link at its discretion. If any portion of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. No failure or delay by BeRank in enforcing any provision shall constitute a waiver of its rights. In the event of any discrepancy between versions of these Terms, the English version shall prevail.
